Important Considerations Regarding Background Checks:

Criminal background history is a major concern to all of our clients. It is important that you understand that criminal background records within a background check must be done at a local level. THERE IS NO NATIONAL CRIMINAL BACKGROUND RECORD DATABASE available to anyone! The closest thing is the NCIC system, available only to law enforcement personnel, which is also notoriously incomplete and inaccurate. (If a company is offering this type of background check to you, they have created their own “national” criminal history database which is not reliable, accurate or complete.) Each State has different ways of recording criminal record information. Some have state-wide criminal record databases but many do not. Each court, at the city or county level, also has its own unique way of recording criminal records and allowing the public access to them. At APS Resources, LLC, we know exactly where and how to look for them in the fastest and most intelligent way to give you quick results without compromising completeness or accuracy.

It should also be stated that background checks are a very imperfect science, and the investigator needs some degree of flexibility to follow the leads wherever they may go. For instance a person who has moved around is a much more difficult subject than one who has remained in the same county throughout their lives. Consequently the levels of searching and related costs will differ greatly, as the degree of investigation will be different for a pre-employment screening for a delivery person than it will be for a potential political candidate or CEO of a Fortune 500 corporation.

Sometimes the best approach is to start looking, and then decide, based on information received, the circumstances and costs, how much deeper to investigate.

And be advised, under the Fair Credit Reporting Act (FCRA), in certain situations such as pre-employment screenings, landlord/tenant agreements, etc., there are Federal rules regarding agreements between requesters (you) and the provider (us), what searches can be conducted, how far back we can report, etc. We at APS Resources, LLC, are FCRA compliant so you will not need to worry about time consuming governmental intrusions.

A due diligence background check may also be used in cases where an investment is being considered in some type of project or venture. The reasoning for this type of background check is simple, to protect the investment and the investors.

For Litigation:

Often, when litigation is commenced, an attorney will want to avoid "surprises" yet have all available information to assist them in representing their clients. A background check can reveal all sorts of things about people that can be used to attack their credibility, truthfulness and to verify or refute the testimony that they provide. Dating is one thing, marriage is another. As licensed private investigators, we are finding more and more people who are in a relationship and are pondering moving into marriage who want to conduct a background check of the soon-to-be spouse. This is another great use of the background check; to protect one’s self. While many people just want to be sure, there is a pattern that shows that the more well off you are, the more likely you are to need this type of service.
